Terms & Conditions of the Online Store

www.thepastelroses.pl

§1. GENERAL PROVISIONS

1.1 These Terms & Conditions define the rules and conditions for using the Online Store, placing and fulfilling Orders, the method of providing free electronic services, and sales conducted by The Pastel Roses Europe Sp. z o.o., based in Majdan, Poland, through the online store www.thepastelroses.pl (hereinafter referred to as the "Online Store").

1.2 The online store operating at www.thepastelroses.pl is run by The Pastel Roses Europe Sp. z o.o., with its registered office in Majdan (05-462), ul. Widoczna 7, Poland,  entered into the Register of Entrepreneurs of the National Court Register (KRS) by the District Court for the capital city of Warsaw, 14th Commercial Division of the National Court Register, under KRS number: 0001150286, NIP (Tax ID): 5322116780, REGON: 540684115.

1.3 The Customer is obliged to read the Terms & Conditions before placing an Order and to accept their content.

1.4 The Terms & Conditions constitute an integral part of the Sales Agreement concluded with the Customer.

1.5 The acceptance of the Terms & Conditions is a condition for placing an Order in the Online Store.

1.6 These Terms & Conditions are continuously available on the Online Store’s website, allowing every User to access and read their content at any time.

1.7 In matters not regulated by these Terms & Conditions, the applicable provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.

1.8 The content published on the Online Store’s website, including product descriptions and prices, constitutes an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.

1.9 The Seller makes these Terms & Conditions and their Attachments available via a link posted on the homepage before, during, and after the conclusion of the Distance Sales Agreement. The Buyer may download and print them.

1.10 To ensure the security of communications and data transmission in connection with the services provided, the Online Store applies appropriate technical and organizational measures ensuring a level of security appropriate to the risk. In particular, these measures prevent unauthorized access to and modification of personal data transmitted via the Internet.

§2. DEFINITIONS

For the purposes of these Terms & Conditions, the following definitions apply:

2.1 Seller, Service Provider – The entity operating the Online Store (being its owner and offering products and free electronic services), i.e., The Pastel Roses Europe Sp. z o.o., based in Majdan (05-462), ul. Widoczna 7, entered into the Register of Entrepreneurs under KRS: 0001150286, NIP: 5322116780, REGON: 540684115.

2.2 Customer – A natural person, legal entity, or an organizational unit without legal personality using the Online Store and placing an order for Products.

2.3 Consumer – A Customer who is a natural person making a purchase not directly related to their business or professional activity, as defined by consumer protection law.

2.4 Service Recipient – A natural or legal person or organizational unit without legal personality but with legal capacity, using the Electronic Service.

2.5 Entrepreneur – A natural or legal person or organizational unit with legal capacity conducting business or professional activity on their own behalf, performing a legal act related directly to this activity.

2.6 User – Any person visiting the Online Store, regardless of whether they make a purchase.

2.7 Product, Goods – A movable item or service available in the Store, being the subject of a Sales Agreement between the Customer and the Seller.

2.8 Delivery – A service consisting of delivering the ordered Products to the Customer via the selected carrier.

2.9 Carrier – The entity cooperating with the Seller in delivering the Goods.

2.10 Delivery Costs – The fee charged for Delivery, depending on the selected transport method and Order value.

2.11 Business Days – Days from Monday to Friday, excluding public holidays.

2.12 Product, Goods – A movable item or service available in the Store, being the subject of a Sales Agreement between the Customer and the Seller.

2.13 Durable Medium – A material or device enabling the Customer or Seller to store information personally addressed to them, in a way that allows access to the information in the future for an appropriate time, and that allows unchanged reproduction.

2.14 Sales Agreement – A distance agreement concluded between the Seller and the Customer through the Online Store regarding the purchase of Products.

2.15 Order – The Customer’s declaration of intent to conclude a Sales Agreement, specifying the quantity and type of Products ordered.

2.16 Store Website – The website under the domain www.thepastelroses.pl, where the Seller operates the Online Store.

2.17 Store – The online store operated by the Seller at www.thepastelroses.pl, allowing Customers to browse the assortment, place orders, and conclude distance sales agreements.

2.18 Customer Account – An individual account created by the User in the Store, enabling the placement of orders, viewing order history, and managing personal data.

2.19 Product Page – A page within the Online Store containing detailed information about a given product, including its name, description, specifications, ingredients, price, availability, photos, and other relevant data to help the Customer decide on a purchase.

2.20 Order Form – A form available at www.thepastelroses.pl enabling the placement of an Order.

2.21 Registration Form – A form available at www.thepastelroses.pl enabling the creation of a Customer Account.

2.22 Contact Form – A form available at www.thepastelroses.pl allowing Users to send a message to the Seller.

2.23 Price – The amount expressed in Polish zloty (PLN) or other currency, which the Customer agrees to pay for a Product; includes VAT unless otherwise specified.

2.24 Cart – A part of the Online Store where the Customer can store selected Products before placing an Order.

2.25 Complaint – The procedure of submitting claims by the Customer regarding defects in Products or inconsistencies between the Order and the Sales Agreement.

2.26 Return – The Consumer’s right to withdraw from the Sales Agreement without giving a reason within the period specified in the Terms & Conditions.

2.27 Newsletter – An electronic service consisting of sending marketing and promotional information to the Customer via email, subject to consent.

2.28 Personal Data – Information relating to an identified or identifiable natural person processed by the Seller in accordance with the Privacy Policy.

2.29 Privacy Policy – A document specifying the rules for the processing of Customers' personal data and the cookie policy applicable to the Online Store.

2.30 Loyalty Program – An optional service offered by the Online Store allowing Customers to collect points for purchases and redeem them for discounts or other benefits.

2.31 Discount Code – A unique code entitling the Customer to receive a discount on selected Products or the entire Order, under the terms of a promotion.

2.32 Promotion, Sale – A time-limited special offer allowing the Customer to purchase Products on more favorable terms or receive additional benefits.

§3. INTELLECTUAL PROPERTY

3.1 All rights to the Online Store, including economic copyrights, rights to the name, domain, logos, templates, forms, and all materials posted on www.thepastelroses.pl, belong to the Seller. Their use is permitted only in accordance with the Terms & Conditions and with the Seller's written consent.

3.2 Any unauthorised use of the website content or elements, including trade names, descriptions, photos, and trademarks, constitutes a violation of copyright and may result in civil and criminal liability.

3.3 By posting reviews in the Online Store that constitute works within the meaning of the Polish

Copyright and Related Rights Act of February 4, 1994, the Customer grants the Seller a non-exclusive, royalty-free, time- and territory-unlimited license to use these works, including the right to sublicense. This includes making the work publicly available online at any chosen time and place.

§4. EXTERNAL LINKS

4.1 The Online Store website may contain links to external websites or services operated by third parties, over which the Seller has no control. Therefore, the Seller bears no responsibility for their content. Full responsibility for the materials posted on such sites rests solely with their provider or operator.

§5. RULES OF USING THE ONLINE STORE

5.1 Use of the Online Store is possible through internet-connected devices with a web browser. An active email address is required to place an Order.

5.2 The User is obliged to use the Store in accordance with the law, these Terms & Conditions, and good practices, in particular to:

a) not provide content that is illegal, offensive, or violates third-party rights,
b) not undertake actions that could disrupt the Store’s operation,
c) provide truthful information when placing orders and registering a Customer Account,
d) use the Online Store in a way that does not disrupt its operation, especially through unauthorized software or devices,
e) not send or place unsolicited commercial information (spam),
f) use all content in the Online Store solely for personal use,
g) not submit or transmit any content prohibited by law, such as content promoting violence, defamatory or infringing on the personal rights and other rights of third parties.

5.3 To make a purchase, the Customer can:

a) shop without registration,
b) register a Customer Account, which enables access to order history and faster repeat purchases.

5.4 The Seller reserves the right to temporarily suspend the Store’s operation, introduce technical or functional changes, and remove content that violates the Terms & Conditions.

5.5 The Seller makes every effort to ensure safe use of the Store. Transactions are secured using standard encryption protocols, and Customer personal data is processed in accordance with applicable law and the Privacy Policy.

5.6 In the event of identifying any malfunctions of the Store, the User may report them to the Seller using the contact information provided on the Store’s website.

5.7 It is prohibited to use the Store's resources and functions for activities that harm the Seller’s interests, including advertising another business or product; posting content unrelated to the Seller’s business; or posting false or misleading content.

5.8 The Seller strives to ensure the Store is accessible to users employing popular web browsers, operating systems, devices, and types of Internet connections.

5.9 To ensure proper functioning of the Online Store, the Seller uses “cookies.” These files are stored on the Customer’s end device when visiting the Store’s website. Their use allows the site to function correctly, optimize features, and tailor content to the Customer’s preferences.

5.10 The Seller collects information about Customers during visits to the Store’s website, purchases, and other interactions. This data is used to process orders and deliver services, and — with the Customer’s consent — to send personalized offers and product recommendations.

5.11 Cookies also support Store performance optimization, display tailored advertisements, and conduct actions to ensure the security of the site and transactions. This mechanism does not damage the Customer’s end device or alter its configuration or software.

5.12 Every Customer can manage cookie settings in their web browser and adjust their preferences regarding marketing communication. However, disabling cookies may affect the Store’s functionality and hinder the use of certain services.

5.13 To place an order and use services provided electronically, the Customer must have an active email account.

5.14 The Seller may revoke a Customer’s right to use the Online Store or restrict access to some or all of its resources with immediate effect in the event of violation of the Terms & Conditions, particularly if the Customer:

a) provided untrue, inaccurate, outdated, misleading, or third-party-infringing data during registration,
b) violated the personal rights of third parties via the Online Store, especially other Online Store customers.

§6. INFORMATION ABOUT PRODUCTS AND ORDERING

6.1 Orders in the Online Store can be placed 24 hours a day, 7 days a week, via the website www.thepastelroses.pl.

6.2 The products available in the Store are new, free from physical defects, and have been legally introduced into the market of Poland and the European Union.

6.3 The information on the Store’s website does not constitute an offer within the meaning of the law. By placing an Order, the Customer submits an offer to purchase a specific Product under the terms described.

6.4 The prices of Products listed in the Online Store are gross prices (including VAT) and are expressed in Polish zloty (PLN). The prices do not include shipping costs, which are added during the ordering process depending on the selected shipping method.

6.5 Shipping costs are shown at the time of placing the order, before finalizing the purchase. The price of the Product visible on the Store's website at the time of placing the Order is binding and will not change regardless of later price updates.

6.6 Product information such as price, availability, specifications, ingredients, expiration date, usage, and safety details are provided in the Product Sheet.

6.7 To place an order, the Customer should:

a) select Product(s) and add them to the Cart,
b) go to the Cart page and click “Proceed to Checkout,”
c) fill out the order form by providing the required information, including shipping address and invoice details (if applicable),
d) choose a payment and delivery method,
e) read and accept the Terms and Conditions and Privacy Policy,
f) click the button to finalize the order, which constitutes an offer to purchase.

6.8 After placing the order, the Customer will receive an automatic confirmation email.

6.9 The sales agreement is concluded when the Customer receives an order confirmation email from the Seller.

6.10 The Seller reserves the right to cancel the order in the event of:


a) incorrect or incomplete data provided by the Customer that prevents order fulfillment,
b) unavailability of the ordered Product – in such cases, the Customer will be informed, and any payment will be refunded,
c) suspicion that the order was placed in violation of the Terms or applicable laws.

6.11 The Customer can track the status of their order via the Customer Account, by using the tracking number in the shipping confirmation email, or by contacting the Seller.

6.12 If the Customer wishes to modify an order, they should contact the Seller as soon as possible. The possibility of changes depends on the order’s processing stage.

6.13 Promotions, discounts, loyalty points, and discount codes cannot be combined unless otherwise stated. The Seller reserves the right to run temporary price reductions and promotional campaigns. Only one discount code can be used per order.

6.14 In the case of limited product availability, orders are processed on a first-come, first-served basis. The Seller does not guarantee product availability until the order is confirmed.

6.15 If technical problems prevent order placement, the Customer can contact the Seller using the contact details provided on the Store's website.

6.16 Placing an order constitutes the Customer’s offer to enter into a Sales Agreement for the ordered Products.

6.17 Confirmation of the Order's acceptance for processing takes place immediately after payment is received, via an email sent to the Customer's address. If the confirmation email is not received, please contact the Store.

6.18 Each Sales Agreement will be confirmed with a proof of purchase (receipt or VAT invoice), which will be attached to the Product and/or sent by email to the address provided in the Order Form.

6.19 If the Customer cancels the Order, the Seller will refund the received payment within 3 business days. The refund will be made using the same payment method that the Customer used when placing the Order.

§7. ACCOUNT REGISTRATION

7.1 Registering a Customer Account in the Online Store is voluntary, free of charge, and is done by filling out the registration form available on the Store’s website.

7.2 To create an Account, the User must provide the following data:


a) first and last name,
b) email address,
c) phone number (optional),
d) delivery address,
e) account password.

7.3 The Customer is responsible for the truthfulness, accuracy, and currency of the data provided during account registration.

7.4 The Customer agrees to keep their login credentials, including the password, secure and inaccessible to third parties.

7.5 The Customer Account is protected by a password created during registration. This password is confidential, and the Customer is responsible for its security. If there is suspicion that the Account has been accessed by an unauthorized person, the Customer should immediately change the password or contact the Seller. The Seller will never ask for login credentials.

7.6 After successfully registering the Account, the User receives an activation confirmation email, enabling full access to Store features.

7.7 The Customer may edit their personal data, including the delivery address and invoice details, through the Account management panel.

7.8 The Customer Account can be deleted at any time upon request by contacting Customer Service. Deleting the Account results in the loss of access to order history and other Account-related functions.

7.9 The Seller reserves the right to suspend or delete the Customer Account in case of violation of the Terms or applicable laws, including providing false data, acting to the detriment of the Store or other Users.

7.10 The Customer Account is available to adults with full legal capacity.

 

7.11 Customers may also register using their Facebook or Google account. Registration begins by redirecting from the Online Store to the login page of the selected service (Facebook or Google). The Customer will be asked to enter their username and password for that service. After successful authorization, the Customer is redirected back to the Online Store, where their Customer Account is automatically created and linked to their Facebook or Google account. The Seller does not store or record login data (username or password) for Facebook or Google. All login data remain under the control of those services and are shared solely according to their respective terms and conditions.

§8. ORDER FULFILLMENT AND SHIPPING INFORMATION

8.1 Order Fulfillment Time – The order fulfillment time is specified on the Product Page and may vary depending on product availability. The standard fulfillment time is between 1 and 14 business days (unless stated otherwise in the product description), counted from:

a) the booking of the funds paid under the Sales Agreement to the Seller’s account, or
b) the positive authorization of the transaction by the electronic payment system.

8.2 Pre-Order Products – Products ordered in pre-sale may have an extended fulfillment time. In such cases, the order fulfillment time may be up to 30 business days from the date the order is placed. The Customer will be informed about the expected shipping time via email to the address provided when placing the order.

8.3 Order Confirmation – After placing an order, the Customer will receive an automatic confirmation email. Once the order is processed and prepared for shipping, the Customer will receive another email with shipping information and a tracking number, if available.

8.4 Shipping Costs – Shipping costs depend on the selected delivery method and are provided during the order process, prior to finalizing the purchase. Delivery costs are added to the total order price.

8.5 Delivery Methods – The store offers the following delivery methods:


a) Courier Delivery – direct delivery to the address specified by the Customer,
b) Parcel Locker – the option to collect the order from a selected parcel locker.

All orders placed via the store www.thepastelroses.pl are shipped from our warehouse located in Poland.

 

8.6 Shipment Tracking – The Customer can track the status of the shipment using the tracking number sent to the email address provided when placing the order. The Customer may also contact the Seller for delivery status updates.

8.7 International Delivery – The store offers international shipping to selected countries. Delivery costs and times vary depending on the destination country and the selected shipping method. Delivery costs are displayed during the order process before finalizing the purchase.

8.8 Customs and Additional Charges – For shipments outside the European Union (EU), the ordered Products may be subject to customs duties, import taxes, and other charges applicable in the destination country. These additional charges are the responsibility of the Customer and may include customs duties, taxes, or other administrative fees imposed by relevant customs authorities. The Seller is not responsible for these additional costs and has no influence on the amount of customs fees, which may vary depending on the country. Customers should contact the appropriate customs office for information regarding potential charges.

8.9 Delivery Delays – Delivery times may be extended due to events beyond the Seller’s control, such as courier delays or force majeure (e.g., strikes, weather conditions). The Seller is not liable for such delays but will make every effort to fulfill the order as soon as possible.

8.10 Reporting Damaged Shipments – In the event of receiving a damaged shipment, the Customer is obliged to immediately report this to the Seller and to take the necessary steps to file a complaint in accordance with the procedure specified by the Seller.

8.11 Product Unavailability – If a Product included in the order is found to be unavailable, the Customer will be promptly informed. The Customer may choose an alternative product, cancel part or all of the order, or wait until the product becomes available.

§9. PAYMENTS

9.1 The store www.thepastelroses.pl offers the following payment methods:

a) Online Payment – fast electronic payments via payment systems (e.g., PayPal, Przelewy24, PayU),
b) Credit/Debit Card Payment – payment using payment cards (Visa, MasterCard),
c) Cash on Delivery – payment in cash or by card upon receipt of the shipment from the courier,
d) Traditional Bank Transfer – payment by bank transfer to the Store’s account. Transfer details will be sent via email after the order is placed.

9.2 Payment Deadlines:

a) For online payments, payment should be made immediately after placing the order,
b) For traditional bank transfers, the Customer has 3 business days to make the payment. If the payment is not made within this period, the order will be canceled,
c) For cash on delivery payments, the Customer pays the courier upon receipt of the package.

9.3 After completing the payment, the Customer receives an email confirmation of the payment and the handover of the order for fulfilment. In the case of a traditional bank transfer, the order will be fulfilled only after the payment has been credited to the Seller’s account.

9.4 The store ensures full security of online payments by using encrypted connections and cooperating with certified payment operators who adhere to the highest standards of personal data and transaction protection.

9.5 Ordered Products will be shipped only after payment has been received.

9.6 In case of problems with payment processing (e.g., declined online payment, transfer error), the Customer will be informed of the need to make the payment again or choose another payment method. The Seller is not responsible for issues caused by third-party payment providers. However, if the Store receives any extra payments due to technical issues, they will be refunded as soon as possible by the Seller or directly by the payment provider (in cases where the funds were not credited to the Seller’s account).

§10. WITHDRAWAL FROM THE CONTRACT

10.1 In accordance with the Consumer Rights Act, the Customer has the right to withdraw from a distance contract (purchased online) within 14 calendar days from the day the goods are received, without providing any reason.

10.2 To exercise the right of withdrawal, you must inform us of your decision by one of the following means:

a) Sending an unambiguous statement via e-mail to support@thepastelroses.com declaring withdrawal from the contract.
b) Using the withdrawal form available on our website.

Please include your order number and contact details in the statement.

10.3 The withdrawal period is 14 calendar days. To meet the deadline, it is sufficient to send the withdrawal statement before the 14-day period expires.

10.4 In the event of withdrawal from the contract, the Consumer bears only the direct cost of returning the Goods.

10.5 In the case of a sale of a single item, the withdrawal period expires 14 days after the Customer or a third party indicated by the Customer (other than the carrier) takes possession of the item.

10.6 In the case of the purchase of Goods delivered in multiple lots or parts, the withdrawal period expires 14 days after the Customer or a third party indicated by the Customer (other than the carrier) takes possession of the last lot or part.

10.7 The return of the Goods will only be accepted if the returned item is in its original condition, unused, and in its original packaging. The Customer is liable for any diminished value of the Goods resulting from use beyond what is necessary to determine the nature, characteristics, and functioning of the Goods.

10.8 We do not accept returns sent with payment on delivery. The Customer is responsible for the cost of returning the Goods.

10.9 The Goods should be returned in suitable packaging to prevent damage during transport.

10.10 In the event of withdrawal from the contract, the Seller will refund the payment using the same payment methods that were used in the original transaction, unless the Customer explicitly agrees otherwise.

10.11 The right of withdrawal from the sales contract by the Customer is excluded in the following cases:

a) Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery,
b) Contracts for the supply of goods which are liable to deteriorate or expire rapidly,
c) Contracts for the supply of goods which after delivery are, according to their nature, inseparably mixed with other items.

§11. COMPLAINTS REGARDING GOODS

11.1 Products purchased in the Online Store that exhibit physical or legal defects, or if the received item is inconsistent with the description, damaged, or incomplete, are subject to complaints.

11.2 The Seller is obliged to deliver Goods free from defects and is liable to the Consumer for defects in the purchased Goods as specified by the Civil Code.

11.3 Complaints arising from the violation of the Customer's rights guaranteed by generally applicable laws or under these Terms and Conditions should be sent to support@thepastelroses.com.

11.4 A complaint should be submitted via the complaint form available on the website or by sending an email to support@thepastelroses.com. The complaint should include the following information:

a) Order number,
b) Customer’s full name,
c) Description of the product and defect,
d) Photographs of the damage or defect (if applicable),
e) Preferred resolution (e.g., product exchange, refund).

11.5 The Seller undertakes to respond to each complaint within 14 days and inform the Customer once the complaint has been reviewed.

11.6 If the product needs to be returned for inspection, the customer will receive detailed instructions regarding the return procedure.

11.7 In the case of a justified complaint, the product will be replaced with a new one (a fully functional product), and if this is not possible (due to stock unavailability), the Seller is obliged to refund the equivalent value of the Product within 14 calendar days.

11.8 If the complaint is deemed justified, the Seller shall bear the costs of exchange, repair, including shipping costs related to the complaint.

11.9 In the case of a product exchange, the shipping cost will be covered by the Store.

11.10 If the complaint is found to be valid, the Customer has the right to withdraw from the contract in accordance with the regulations on distance contracts.

11.11 Complaints will not be considered for mechanical damage to the product caused by improper use or transportation by the Customer.

11.12 A complaint will not be accepted if the Product was used in a manner inconsistent with its intended purpose or was damaged by the Customer.

§12 DELIVERY OF DAMAGED OR MISSING GOODS

12.1 Upon receipt of the shipment from the Delivery Provider, the Customer is obliged to inspect it within the time customary for shipments of this type and to immediately report any visible damage to the package or products to the Seller, as well as to report any missing items. A complaint report should be prepared, including photos of the damaged products and a copy of the invoice listing the products, which is included with the order.

§13 TYPE AND SCOPE OF ELECTRONIC SERVICES

13.1 The Service Provider enables the use of electronic services such as:

a) concluding Sales Agreements,
b) managing an Account in the Store,
c) Review System,
d) Newsletter.

13.2 The provision of services is free of charge. The Service Provider has the right to place advertising content on the Store’s website.

§14 COMPLAINTS REGARDING THE PROVISION OF ELECTRONIC SERVICES

14.1 The Seller undertakes actions to ensure the correct operation of the Store, to the extent resulting from the current technical knowledge, and commits to correcting any issues reported by Customers within a reasonable time.

14.2 The Customer is obliged to promptly notify the Seller of any irregularities or service interruptions of the Online Store at the email address: support@thepastelroses.com.

14.3 In the complaint, the Customer should provide their name, correspondence address, type, and date of occurrence of the irregularity related to the operation of the Store.

14.4 The Seller undertakes to consider each complaint within 14 days. If that is not possible, the Customer will be informed within this period when the complaint will be resolved.

§15 WARRANTY

15.1 The Seller does not provide a warranty for the goods offered in the Online Store, unless otherwise stated in the product description on the Online Store.

§16 REPORTING A THREAT OR VIOLATION OF RIGHTS

16.1 If a Customer or any other person or entity believes that content published on the Store’s Website violates their rights, personal interests, good morals, feelings, morality, beliefs, principles of fair competition, know-how, or legally protected secrets or obligations, they may notify the Seller of the potential violation.

16.2 Upon being notified of a potential violation, the Seller will take immediate action to remove the content that is the cause of the violation from the Store’s Website.

§17 PERSONAL DATA PROTECTION

17.1 The rules for the protection of Personal Data are provided in the Privacy Policy.

§18 SAFETY NOTICE

18.1 The Seller is not liable for any damages, including harm to health, resulting from improper use of the products.

18.2 The Consumer is obliged to carefully read the warnings and usage recommendations provided on the product packaging before use.

§19 FINAL PROVISIONS

19.1 All disputes arising from Sales Agreements concluded between the Store and the Consumer shall initially be resolved through negotiation, with the aim of reaching an amicable settlement, in accordance with the provisions of the Act on out-of-court consumer dispute resolution. If negotiations do not lead to a satisfactory solution, the dispute will be resolved by the competent common court with jurisdiction over the Seller’s registered office.

19.2 The Seller informs Customers who are Consumers about the possibility of using out-of-court complaint and claim procedures. The rules for access to these procedures are available at the premises or on the websites of entities authorized to handle out-of-court dispute resolution. These may include, in particular, consumer rights ombudsmen or Voivodeship Inspectorates of Trade Inspection, the list of which is available on the website of the Office of Competition and Consumer Protection. The Seller informs that the online dispute resolution platform between consumers and businesses at the EU level (ODR platform) is available at: http://ec.europa.eu/consumers/odr/.

19.3 In the case of sales agreements concluded with Customers who are not Consumers, the provisions of Polish law on statutory warranty for physical defects of sold goods shall not apply.

19.4 In matters not regulated by this Terms and Conditions document, the provisions of Polish law shall apply.

19.5 These Terms and Conditions do not limit any rights of Customers who are Consumers guaranteed to them under universally binding laws in the territory of the Republic of Poland.

19.6 The Seller reserves the right to amend these Terms and Conditions for important reasons, including but not limited to changes in the law, issuance of administrative acts requiring specific conduct by the Seller, court rulings requiring specific conduct, changes in the technical conditions of provided services, technological advancements, organizational changes at the Seller, or changes in the Seller’s business activities.

19.7 In the event of an amendment to the Terms and Conditions, the Seller will inform the Customer of the change via email. The amended Terms and Conditions will become effective after fourteen days from the date of notifying the Customer, unless the Customer objects to the change within that period. In the case of such an objection, the Customer’s registration will be deleted. The change of the Terms and Conditions does not affect the execution of Orders placed prior to the expiration of the aforementioned period, which will be fulfilled under the previous Terms and Conditions.

19.8 All content presented on the Online Store, in particular product descriptions and images, are protected by copyright. Any further use of such content requires the Seller’s consent.

19.9 These Terms and Conditions come into effect on May 1, 2025.
